Welcome to TarikMendes.com. These Terms & Conditions (“Terms”) govern your access to and use of this Website, including the purchase of artwork, sculptures, prints, commissions, merchandise, and related services offered by Tarik Mendes (“we,” “our,” or “us”).

By accessing or using this Website, or by placing an order, you agree to be bound by these Terms, our Terms of Sale, Privacy Policy, and Terms of Use.

1. About Tarik Mendes

Tarik Mendes is a contemporary multidisciplinary artist creating original paintings, sculptures, mixed-media works, limited editions, commissions, and other creative works. Each artwork is individually produced, making every piece unique.

2. Acceptance of Orders

All orders are subject to artwork availability and acceptance.

After placing an order, you will receive an order confirmation acknowledging receipt of your purchase request. This confirmation does not constitute acceptance of your order.

We reserve the right to refuse or cancel any order at our sole discretion, including orders involving pricing errors, payment authorization issues, suspected fraud, or unavailable artwork.

3. Pricing

All prices are listed in U.S. Dollars (USD).

Although every effort is made to ensure pricing accuracy, errors may occasionally occur.

If a pricing error is discovered, we reserve the right to cancel the order or contact you with the corrected price before processing.

Prices may change without prior notice.

4. Payment

Payment is required at the time an order is placed.

Orders will not be processed or shipped until payment has been successfully authorized.

We accept approved payment methods displayed during checkout.

5. Shipping & Delivery

Shipping options and estimated delivery dates are provided during checkout.

Delivery dates are estimates only and are not guaranteed.

We are not responsible for delays caused by shipping carriers, customs processing, weather, labor disputes, government actions, or other events beyond our reasonable control.

Risk of loss transfers to the customer once the shipment has been delivered to the shipping carrier.

6. Order Inspection

Please inspect your order immediately upon delivery.

If your artwork or merchandise arrives damaged or incorrect, you must notify us through the Contact page on this Website within seventy-two (72) hours of delivery and include photographs of the item and packaging.

7. Returns

Eligible merchandise may be returned within seventy-two (72) hours of delivery.

Returned items must:

  • Be unused and in original condition.
  • Include all original packaging and documentation.
  • Include proof of purchase.
  • Receive prior Return Authorization before shipment.

Customers are responsible for return shipping costs unless the return is due to our error.

Original shipping charges are non-refundable.

8. Original Artwork, Commissions & Custom Orders

Because original artwork and commissioned works are created specifically for collectors, all original artwork, commissions, custom artwork, made-to-order pieces, and personalized works are final sale.

This includes, but is not limited to:

  • Original paintings
  • Original sculptures
  • Commissioned artwork
  • Custom installations
  • Personalized artwork
  • Site-specific projects
  • One-of-one works
  • Artwork created specifically for a client

Production begins once the project has been approved by the client.

Approved commissioned or custom projects cannot be canceled, exchanged, or refunded.

9. Consultations & Project Proposals

Consultations, project proposals, sketches, or digital renderings may be offered for commissioned projects.

Any applicable consultation or design fees will be communicated before work begins.

Unless otherwise stated, consultation fees are non-refundable but may be credited toward the final commissioned project at our discretion.

10. Artwork Variations

Each artwork is individually created by hand.

Natural variations in:

  • Color
  • Texture
  • Layering
  • Materials
  • Surface
  • Finish
  • Dimensions

are inherent characteristics of original artwork and are not considered defects.

Artwork images are intended as representations only. Colors and appearance may vary depending on photography, lighting conditions, and individual monitor or device settings.

11. Intellectual Property

All artwork, images, photographs, sculptures, designs, text, graphics, logos, branding, and other content displayed on this Website are protected by copyright and other intellectual property laws.

Unless otherwise stated, all rights are reserved by Tarik Mendes.

The purchase of artwork does not transfer copyright, reproduction rights, licensing rights, or commercial usage rights.

No content from this Website may be copied, reproduced, published, distributed, modified, sold, or used for commercial purposes without prior written permission.

12. Website Use

You agree not to:

  • Use this Website for unlawful purposes.
  • Attempt unauthorized access to our systems or servers.
  • Copy, scrape, or reproduce Website content.
  • Interfere with the operation, security, or availability of the Website.
  • Upload malicious software or harmful code.

13. Limitation of Liability

To the fullest extent permitted by law, Tarik Mendes shall not be liable for indirect, incidental, consequential, punitive, or special damages arising from the use of this Website or the purchase or use of any artwork, merchandise, or services.

Our total liability shall never exceed the amount actually paid for the applicable order.

14. Disclaimer of Warranties

Except where required by applicable law, all artwork, products, services, and Website content are provided “AS IS” and “AS AVAILABLE.”

Because every artwork is handcrafted and original, no guarantee is made that individual works will be identical to photographs, previous works, or earlier commissions.

15. Governing Law

These Terms & Conditions shall be governed by the laws of the State of New York, without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved exclusively in the appropriate state or federal courts located in New York.

16. Changes to These Terms

We reserve the right to update these Terms & Conditions at any time.

Revised versions become effective immediately upon publication on this Website.
