These Terms of Sale (“Terms”) govern all purchases made through TarikMendes.com and apply to all artwork, sculptures, prints, merchandise, commissions, and related products or services offered by Tarik Mendes (“Tarik Mendes,” “we,” “our,” or “us”).

By placing an order through our Website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Sale, as well as our Terms of Use and Privacy Policy.

1. Eligibility

By placing an order, you represent and warrant that:

  • You are at least 18 years of age or have the permission of a parent or legal guardian.
  • All information you provide is accurate and complete.
  • You are authorized to use the payment method submitted.
  • Sufficient funds are available to complete your purchase.

2. Pricing

We strive to ensure that all artwork descriptions, dimensions, pricing, and availability are accurate. However, errors may occasionally occur.

We reserve the right to correct pricing, typographical, or product description errors at any time without prior notice.

If an incorrect price has been displayed, we reserve the right to cancel the order before shipment. If payment has already been processed, a full refund will be issued.

Prices are subject to change without notice.

Applicable taxes and shipping charges will be calculated during checkout.

3. Product Availability

All artwork and products are subject to availability.

Because many works are original or limited edition, availability may change without notice.

We reserve the right to discontinue products, limit quantities, refuse any order, or withdraw artwork from sale at our sole discretion.

4. Order Acceptance

After placing an order, you will receive an order confirmation acknowledging receipt of your purchase request.

This confirmation does not constitute acceptance of the order.

An order is considered accepted only after payment has been successfully processed and the order has been prepared for shipment.

We reserve the right to refuse or cancel any order for reasons including, but not limited to:

  • Artwork no longer being available
  • Pricing or listing errors
  • Payment authorization issues
  • Suspected fraud
  • Violation of these Terms

5. Payment

Payment authorization is completed at the time your order is placed.

Orders will not be shipped until payment has been successfully authorized.

We accept approved payment methods displayed during checkout.

6. Shipping & Delivery

Orders are shipped using the shipping method selected during checkout.

Estimated delivery dates are provided for convenience only and are not guaranteed.

We are not responsible for delays caused by:

  • Weather
  • Customs processing
  • Shipping carriers
  • Labor disruptions
  • Government actions
  • Natural disasters
  • Force majeure events
  • Circumstances beyond our reasonable control

Risk of loss transfers to the customer once the shipment has been delivered to the shipping carrier.

7. Customer Inspection

Customers should inspect all artwork and merchandise immediately upon delivery.

Any visible damage, shipping issues, or defects must be reported in writing through the Contact page on this Website within seventy-two (72) hours of delivery.

If no written notice is received within this period, the order will be considered accepted.

8. Returns for Eligible Merchandise

Eligible merchandise may be returned within seventy-two (72) hours of delivery, provided that:

  • The item is unused and in its original condition.
  • Original packaging and any included documentation accompany the return.
  • A Return Authorization (RA) has been issued.
  • The return is shipped within three (3) business days after receiving the RA.

Returns received without prior authorization will not be accepted.

Customers are responsible for return shipping costs.

Original shipping charges are non-refundable.

9. Refunds

Returned merchandise will be inspected upon receipt.

If approved:

  • Refunds will be issued to the original payment method.
  • Original shipping charges are non-refundable.
  • A 15% restocking fee may be deducted from the refund.

If merchandise has been altered, damaged, improperly handled, or cannot be resold, we reserve the right to reduce or deny the refund based on the item’s condition.

10. Order Changes & Cancellations

Orders may not be canceled, modified, or delayed after they have been accepted without prior written approval.

If a cancellation is approved, processing expenses, production costs, and applicable restocking fees may be deducted from any refund.

11. Original Artwork, Commissions & Custom Orders

All original artwork, commissioned works, custom pieces, made-to-order artwork, personalized artwork, sculptures, and one-of-one creations are final sale.

This includes, but is not limited to:

  • Original paintings
  • Original sculptures
  • Commissioned artwork
  • Site-specific installations
  • Custom artwork
  • Personalized artwork
  • One-of-one works
  • Artwork created specifically for a client
  • Limited-edition commissioned pieces

These orders:

  • Cannot be canceled after approval.
  • Cannot be exchanged.
  • Cannot be returned.
  • Are not eligible for refunds.

Full payment may be required before production begins.

12. Consultations & Design Proposals

We may provide consultations, sketches, digital renderings, or project proposals before beginning commissioned work.

Any consultation or design fees will be disclosed before work begins.

Where applicable, approved consultation fees may be credited toward the final purchase.

13. Handmade Artwork & Natural Variations

Every artwork is individually created by hand.

Due to the nature of original art, slight variations in:

  • Color
  • Texture
  • Surface
  • Layering
  • Materials
  • Finish
  • Dimensions
  • Presentation

are natural characteristics of handcrafted artwork and are not considered defects.

Colors displayed on digital devices may vary slightly from the original artwork due to monitor settings, photography, and lighting conditions.

14. Copyright & Intellectual Property

All artwork, photographs, images, designs, text, and other creative content displayed on this Website remain the exclusive intellectual property of Tarik Mendes unless otherwise stated.

The purchase of artwork does not transfer copyright or reproduction rights.

Artwork may not be copied, reproduced, distributed, modified, published, licensed, or used commercially without prior written permission.

15. Disclaimer of Warranties

Except where prohibited by law, all products are sold “AS IS” and “AS AVAILABLE.”

We disclaim all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

16. Limitation of Liability

To the fullest extent permitted by law, Tarik Mendes shall not be liable for indirect, incidental, consequential, punitive, or special damages arising from the purchase or use of any artwork or product.

Where permitted by law, total liability shall not exceed the amount actually paid by the customer for the item giving rise to the claim.

17. Governing Law

These Terms of Sale shall be governed by the laws of the State of New York.

Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in New York.

18. Changes to These Terms

We reserve the right to revise these Terms of Sale at any time.

Updated versions become effective immediately upon publication on this Website.
